These Terms of Use (“Terms”) govern your use of the Mind-Body Evolution website, STONE mobile application, STONE device, and related services (collectively, the “Services”) provided by Mind-Body Evolution, LLC (“Mind-Body Evolution,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to these Terms.

STONE is a technology-enabled wellness platform designed to support breathing and mind-body practices. The STONE device may provide vibration-based breathing cues and collect physiological information that is used to provide feedback and personalize breathing practices.

You are responsible for using STONE and the Services according to the instructions provided.

STONE and the Services are intended for general wellness and educational purposes.

STONE is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Information, measurements, scores, recommendations, or other content provided through STONE should not be considered medical advice, diagnosis, or treatment.

The Services are not a substitute for consultation with a qualified healthcare professional.

STONE may collect physiological signals, including electrocardiogram (ECG) information, and may derive measures such as heart rate, heart-rate variability (HRV), stress-related measures, and relaxation or recovery measures.

These measurements and scores are intended to support wellness and breathing practices and should not be interpreted as clinical measurements or medical diagnoses.

You should use breathing practices within your own comfort level.

Stop a breathing practice if you experience significant discomfort, dizziness, faintness, unusual shortness of breath, chest pain, or other concerning symptoms. Seek appropriate medical attention when necessary.

If you have a medical condition or concerns about whether breathing practices are appropriate for you, consult an appropriate healthcare professional.

Certain features of the Services require an account. You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account.

You agree to provide accurate information and to update your information when appropriate.

Your use of the Services is also governed by the Mind-Body Evolution Privacy Policy, which describes how we collect, use, store, and share information.

You agree not to misuse the Services, interfere with their operation or security, attempt unauthorized access, reverse engineer the Services except where permitted by law, or use the Services for unlawful purposes.

The STONE device, application, software, designs, content, trademarks, logos, algorithms, and related intellectual property are owned by or licensed to Mind-Body Evolution, LLC and are protected by applicable intellectual-property laws.

These Terms do not transfer ownership of any Mind-Body Evolution intellectual property to you.

We may modify, update, suspend, or discontinue features of the Services from time to time. We do not guarantee that every feature will always be available or operate without interruption or error.

To the extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis. We do not guarantee that the Services will always be uninterrupted, error-free, or suitable for every individual.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

To the extent permitted by applicable law, Mind-Body Evolution, LLC and its affiliates, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to use of the Services.

Nothing in these Terms limits liability that cannot legally be limited under applicable law.

You may stop using the Services at any time and may delete your account through the account-deletion functionality provided by the Services.

We may suspend or terminate access where reasonably necessary to protect users, maintain security, comply with law, or address material violations of these Terms.

We may update these Terms periodically. When we do, we will update the effective date above. Continued use of the Services following an update constitutes acceptance of the revised Terms to the extent permitted by applicable law.
